Privacy Statement


The protection of your privacy is very important to EQUIscan when processing your data. The data collected is processed according to the provisions of the Bundesdatenschutzgesetz (BDSG, Federal Data Protection Act), the General Data Protection Regulation (GDPR) and other legal regulations as they apply to electronic business transactions in Germany.

The processing of personal data by us generally serves the purpose of fulfilling the contract with you within the context of Art. 6 para. 1 lit. b GDPR or to safeguard our legitimate interests, above all our accountability to the tax authorities and our interest in optimizing our websites and advertising within the context of Art. 6 para. 1 lit. f GDPR.

If there is not one of the aforementioned legal provisions, we will obtain your consent in accordance with Art. 6 para. 1 lit. a GDPR prior to data processing. You will find detailed information on data processing in the following explanations. EQUIscan therefore asks you to take note of these and, if necessary, to print or save them.

  1. Use of “Cookies”:

When you visit our website, information in the form of “cookies” is temporarily or permanently stored on your computer/device, which automatically recognizes you the next time you visit our website. “Cookies” are small text files which allow, e.g., the adaptation of an application to the visitor’s interests. If you do not want “cookies” to be stored by EQUIscan, you are asked to set the end device to delete these “cookies”, to block all or certain “cookies” or to issue a warning before any “cookies” are stored.

 

  1. Automatically Recorded Non-Personal Data:

When you visit our website the name of your Internet service provider, the website from which you came, the websites you visit on our website and the date and duration of your visit are stored by our web server as default.

EQUIscan uses this information to determine and improve the attractiveness, performance and content of the website.
No personal data will be collected by EQUIscan. You can find further information on the cookies used by us in paragraph 5.

  1. Collection, Processing, Use and Forwarding of Personal Data

4.1       Personal data is only collected by EQUIscan if you actively communicate it to us, e.g. by creating a customer account, by ordering our newsletter or via our contact form. You have the right to object at any time to the use of this data for the respective purpose for the future. See also paragraph 8.

4.2       The personal data collected from you will only be used for the purpose for which you gave it to us or for the use and forwarding of which you gave us your consent. After completion of the contractual relationship the user data shall only be stored as long as is required on the basis of fiscal and commercial law retention periods. On expiry of these periods the data will, however, be deleted, unless you gave your express consent to its further or different use. You can also assert rights during the storage periods, such as blocking your data. See paragraph 8.

4.3       Personal data shall only be collected or transmitted to government institutions and authorities, where this is required by compulsory national legal regulations.

4.4     Furthermore, your data will be forwarded to these companies in order to process the contractual relationship:

  • forwarding agency
  • payment service providers
  • tax consultancy

4.5       EQUIscan’s employees and subcontractors are contractually bound to maintain confidentiality and data secrecy.

  1. reCaptcha by Google LLC:

To protect your requests via internet form we use the service reCaptcha, which is offered by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States. Data is processed on the basis of a legitimate interest in the statistical analysis of user behaviour for optimisation and marketing purposes pursuant to Art. 6 para. 1 lit. f GDPR. Google is is a member of the EU-US Privacy Shield, which sets minimum standards for the protection of personal data of Europeans whose data is stored or processed in the USA.

The query serves to differentiate whether the entry is made by a person or abusively by automated machine processing.

Google collects the following data for this: the information from the page where CAPTCHA is integrated, the IP address of the connection, the screen and window resolution, the language set in the browser, the time zone in which you are, the browser plugins installed on your terminal device, the additional cookies already available from Google and, if applicable, further data.

According to Google, the IP address collected within the EU Member States or in other contractual states of the Agreement on the European Economic Area is already shortened and is only transmitted in full to servers in the USA in exceptional cases, where it is then shortened. In the framework of reCaptcha, the IP address transmitted by your browser is not merged with other Google data, according to Google.

Our website may contain links to other websites. EQUIscan is not responsible for their privacy statements or content.

  1. Use of Social-PlugIns:

This offer uses social plugins (“plugins”) from social networks (hereinafter SN), which are listed in the following sections.

When you visit a page on our website that contains an SN plug-in, your browser establishes a direct connection to the SN’s servers. The content of the PlugIn is transmitted directly from the SN to your browser and from there integrated into the website. We therefore have no influence on the amount of data that the respective SN collects with the help of the plug-ins. We can therefore only inform you according to our level of knowledge.

By integrating the plug-ins, the SN receives the information that you have called up the corresponding page of our website. If you are logged in as a member of the SN, the SN may assign the visit to our websites to your member account with the SN concerned. If you interact with the PlugIn, for example by pressing the SN button or making a comment, the corresponding information is transmitted directly from your browser to the SN and stored there.  If you are not a member of the SN, the SN may still obtain and store your IP address.

For the purpose and scope of data collection and the further processing and use of the data by the respective SN as well as the relevant rights and setting options for the protection of the privacy of the users, please refer to the data protection declarations of the respective SN.

If you are a member of an SN and do not want the SN to collect data about you via our website and link it to your data at the SN, you must log out of your SN before visiting our website.

The plugins can be identified by one of the Facebook logos (white “f” on blue tile or a “thumbs up” sign) or are marked with the addition “Facebook Social Plugin”. The list and the appearance of the Facebook Social Plugins can be viewed here.

Facebook’s privacy policy can be found here. According to Facebook, only an anonymized IP address is stored in Germany.

It is possible to block Facebook social plugins with add-ons for your browser, for example with the “Facebook Blocker”.

7.2       Twitter Inc., 795 Folsom St., Suite 600, San Francisco, CA 94107, USA:

Plug-ins are recognizable by terms such as “Twitter” or “sequence”, combined with a stylized blue bird. With the help of the buttons it is possible to share a post on Twitter or to follow the provider on Twitter.   1. Information on user rights:

Upon request, EQUIscan will inform you in writing as soon as possible whether and which of your personal data is stored by us.  If, despite our efforts to ensure that the data is correct and up to date, incorrect data is stored, it will be rectified by us accordingly. In addition to this right to correction, you also have the right to block and delete the personal data we have collected.

In addition, you have the right to request that we transmit the data to you as a structured, standard and machine-readable format or, at your express request, forward it to a third party.

You may object to the use of your data for future purposes, i.e. for purposes other than contract processing. In particular, you may object to the use of your data for advertising purposes. You also have the right to request only a restriction of data use for certain purposes.
